By using any Hynivo AI Feature, you accept these AI Terms. They supplement our Terms of Service. Capitalised terms not defined here have the meaning given in the Terms of Service.
1. Acceptance and consent to AI processing
By submitting Input to an AI Feature you:
- acknowledge that you are interacting with an artificial intelligence system, not a human, unless we clearly state otherwise;
- consent to your Input being processed by automated AI systems, including models operated by trusted third-party providers acting on our behalf, for the purpose of generating your Output, operating safety systems and providing the Services;
- confirm you have read and accept these AI Terms, our Acceptable Use Policy and our Privacy Policy.
You may withdraw consent to AI processing at any time by ceasing to use the AI Features and updating your Consent Preferences. AI Features cannot operate without processing your Input.
2. Model training — opt-in only
- We do not use your Input or Output to train, retrain or fine-tune AI models by default.
- You may choose to allow de-identified samples to be used for evaluation, training and safety improvement by enabling "AI training & improvement" on our Consent Preferences page or in your account.
- This consent is separate from all other consents, is never a condition of using the Services, and can be withdrawn at any time. Withdrawal prevents future use; data already incorporated into a trained model may not be extractable, but will not be used for further training.
- We contractually prohibit our third-party AI providers from training their models on your data.
3. Nature and limitations of AI Output
You understand and agree that:
- AI models are probabilistic. Output may be inaccurate, outdated, incomplete, misleading, biased or offensive, and may "hallucinate" facts, quotations, citations, people or events.
- Output may not be unique. Other users may receive the same or similar Output.
- Output does not reflect the views of Hynivo Ltd.
- Output is not professional advice — including legal, medical, psychological, financial, tax, investment, engineering or safety advice — and must not be relied on as a substitute for a qualified professional.
- You are solely responsible for reviewing, verifying and deciding whether to use any Output, and for any consequences of that use.
4. Ownership of Input and Output
- You retain all rights you hold in your Input.
- Subject to your compliance with our terms, we assign to you all our rights, title and interest, if any, in Output generated for you.
- Copyright and other IP protection for AI-generated material varies by country and may be limited or unavailable. We make no representation that Output is protectable or free from third-party rights.
- You must not use Output in a way that infringes others' rights, including trademarks, copyright, likeness or publicity rights.
5. Your responsibilities
- Have all rights and lawful bases needed for your Input, including consent from any person whose personal data, image, likeness or voice you submit.
- Do not submit sensitive personal data, confidential information belonging to others, or regulated data (e.g. health records, payment card data) unless you have a lawful basis and we have agreed in writing to support it.
- Comply with the Acceptable Use Policy and all applicable laws, including AI-specific regulations (such as the EU AI Act) where they apply to your use.
- Keep appropriate human oversight when using Output for decisions that affect people.
6. Transparency and labelling of AI content
- Where required by law or our policies, you must disclose that content is AI-generated when publishing or sharing it, particularly for realistic images, audio or video depicting real people, places or events ("deepfakes"), or text published to inform the public on matters of public interest.
- We may embed watermarks, metadata or content credentials in Output. You must not remove, alter or obscure them.
- You must not present AI Output as human-created where that would mislead others.
7. High-risk and prohibited AI uses
You must not use AI Features to:
- make solely automated decisions that have legal or similarly significant effects on individuals (e.g. employment, credit, insurance, housing, education, healthcare, legal status, access to essential services) without meaningful human review;
- carry out biometric identification, categorisation of people by sensitive characteristics, emotion recognition in workplaces or schools, or social scoring;
- manipulate people through subliminal or deceptive techniques, or exploit vulnerabilities due to age, disability or circumstance;
- create non-consensual intimate imagery, any sexual content involving minors, or impersonate real people without consent;
- generate disinformation, election interference or fraudulent content;
- develop weapons, malware or content that facilitates serious harm;
- any other purpose prohibited by the Acceptable Use Policy or law.
8. Safety systems and moderation
We use automated filters and, in limited cases, human review to detect and prevent misuse. We may refuse, block, alter or remove Input or Output, and may suspend accounts, where we reasonably believe content violates our policies or the law. Attempting to bypass safety measures ("jailbreaking", prompt injection against our systems) is prohibited.
9. Human oversight and the right to contest
If an AI-assisted decision by Hynivo (such as content moderation or account action) affects you, you may request human review, provide your perspective and contest the decision by emailing [email protected] with the subject "AI appeal". We will respond within 30 days.
10. Third-party AI providers
Some AI Features are powered by models licensed from third parties. Those providers act as our processors and are bound by confidentiality, security and no-training obligations. Their models may change; we may switch providers to maintain quality, cost or safety without notice, provided this Policy's protections continue to apply.
11. Availability, changes and beta features
AI Features evolve quickly. We may modify, update, limit or discontinue models and features. Features labelled "beta", "preview" or "experimental" are provided as-is, may be less reliable and may be changed or withdrawn at any time.
12. Disclaimer and liability
AI Features are subject to the disclaimers and limitations of liability in sections 13 and 14 of our Terms of Service. In particular, Hynivo Ltd is not responsible for decisions you make or actions you take based on Output.
13. Reporting concerns
If you encounter harmful, biased, infringing or unlawful Output, please report it to [email protected] with the subject "AI concern", including the Input, Output and date if possible.
